Father’s Financial Liabilities No Excuse to Deny Child Support: HC
The Uttarakhand High Court has ruled that a father cannot escape his legal duty to maintain his minor child by citing the mother’s income or his own financial liabilities.
Justice Ashish Naithani upheld an order of a family court in Roorkee directing a man to pay ₹8,000 per month as interim maintenance for his child.
The High Court dismissed a review petition filed by the man, who had challenged the lower court’s order passed under Section 125 of the Code of Criminal Procedure.
The judgment reaffirmed that the responsibility to support a minor child remains a primary obligation of the father under law.
