The Calcutta High Court has revived its earlier stay on OBC reservations for 114 classes after the West Bengal government withdrew the previous administration’s Supreme Court challenge, with implications for candidates appearing in national and state-level examinations.
The Calcutta High Court has said that its earlier stay on OBC reservations for 114 classes has been revived after the current West Bengal government withdrew the previous administration’s Special Leave Petition (SLP) challenging the order before the Supreme Court.
In a related matter, the court declared an OBC-A certificate invalid and ruled that the petitioner and other candidates who appeared for the National Eligibility cum Entrance Test (NEET) while claiming OBC status under the central list must be treated as general category candidates.
The court also said that the state government or the appropriate competent authority may take suitable steps in the interest of students from West Bengal who claim OBC status under classes that pre-existed 2010 and participate in national and state-level examinations.
The ruling comes amid continuing legal proceedings surrounding West Bengal’s OBC classification and reservation framework. The withdrawal of the earlier SLP before the Supreme Court has resulted in the High Court’s previous stay becoming operative again.
The court’s observations could have implications for students and candidates seeking to claim OBC status in competitive examinations, particularly where eligibility depends on recognition under the relevant state or central OBC lists.
