The Delhi High Court has declined to grant anticipatory bail to a man accused in a cyber fraud case involving the transfer of cryptocurrency valued at approximately ₹1 crore.

Justice Swarana Kanta Sharma observed that the allegations, at this stage of the investigation, prima facie indicated the existence of an organised cyber fraud network linked to digital currency transactions. The court held that custodial interrogation of the accused was necessary to uncover the full extent of the alleged offence and identify other individuals who may be involved.

According to the complaint, the accused, identified as Gaurav, came into contact with the complainant through a mutual acquaintance in 2024. Over the course of their interactions, he allegedly persuaded the complainant to transfer digital assets worth nearly ₹1 crore.

The prosecution argued that the nature of cryptocurrency transactions, often involving complex digital trails and multiple intermediaries, necessitated a thorough investigation. It contended that granting pre-arrest bail at this stage could hamper efforts to trace the movement of funds and gather crucial evidence.

The court took note of the increasing sophistication of cyber-enabled financial crimes and emphasised the need for effective investigation mechanisms to address offences involving virtual digital assets. Justice Sharma observed that custodial interrogation could assist investigators in identifying the modus operandi adopted by the accused and uncovering any larger conspiracy.

Cyber fraud involving cryptocurrencies has emerged as a growing concern in India and globally, with law enforcement agencies facing challenges in tracking digital transactions that frequently transcend geographical boundaries.
