Noida Workers’ Protest Case Reaches Supreme Court

The Supreme Court of India continued hearing a plea filed by an accused in the Noida workers’ protest case who claims to be a journalist and has challenged his detention under the National Security Act (NSA).

The petitioner has also contested multiple FIRs registered against him in connection with the protests, alleging that the action taken by authorities was unjustified.

During the hearing, counsel appearing for the accused-journalist argued that the police accused his client of provoking unrest based on his ideology rather than any direct involvement in violent acts. The counsel submitted that while there may be allegations of violence against some protestors or workers, no such accusations were specifically attributable to the journalist.

The Court observed during proceedings that the protest was initially intended to remain peaceful but later turned violent.

After hearing preliminary submissions, the Supreme Court issued notice to the Uttar Pradesh government seeking its response to the plea challenging the detention order under the NSA.

The case relates to protests involving workers in Noida, which allegedly escalated into unrest and violence. Authorities subsequently invoked provisions of the National Security Act against certain accused persons, including the journalist.

The NSA allows preventive detention in matters concerning national security and public order. Legal experts note that the law has often been subject to judicial scrutiny over issues relating to individual liberty, freedom of expression, and procedural safeguards.

The matter is expected to come up for further hearing after the Uttar Pradesh government files its response before the apex court.
